Tragedi Stadion Kanjuruhan Malang: Negara Harus Bertanggung Jawab Atas Jatuhnya Korban Jiwa

JAKARTA, SRIWIJAYAPLUS.COM-  YLBH dan LBH Kantor Seluruh Indonesia menyampaikan bela sungkawa sedalam-dalamnya atas jatuhnya korban jiwa dan luka-luka dalam tragedi di Stadion Kanjuruhan usai laga sepakbola Arema vs Persebaya, Sabtu malam 1 Oktober 2022.

”Kami mendapat laporan hingga pukul tujuh korban jiawa 153 dari kejadian ini,” tulis rilis yang diterima redaksi SRIWIJAYAPLUS.COM.

Sejak awal panitia mengkhawatirkan akan pertandingan ini dan meminta kepada Liga (LIB) agar pertandingan dapat diselenggarakan sore hari untuk meminimalisir resiko.

Tetapi sayangnya pihak Liga menolak permintaan tersebut dan tetap menyelenggarakan pertandingan pada malam hari.

Pertandingan berjalan lancar hingga selesai, hingga kemudian kerusuhan terjadi setelah pertandingan dimana terdapat supporter memasuki lapangan dan kemudian ditindak oleh aparat.

Dalam video yang beredar, kami melihat terdapat kekerasan yang dilakukan aparat dengan memukul dan menendang suporter yang ada di lapangan.

Ketika situasi suporter makin banyak ke lapangan, justru kemudian aparat melakukan penembakan gas air mata ke tribun yang masih banyak dipenuhi penonton.

Kami menduga penggunaan kekuatan yang berlebihan (excessive use force) melalui penggunaan gas air mata dan pengendalian masa yang tidak sesuai prosedur menjadi penyebab banyaknya korban jiwa yang berjatuhan.

Penggunaan gas air mata yang tidak sesuai dengan Prosedur pengendalian massa mengakibatkan suporter di tribun berdesak-desakan mencari pintu keluar, sesak nafas, pingsan dan saling bertabrakan.

Hal tersebut diperparah dengan over kapasitas stadion dan pertandingan big match yang dilakuka  pada malam hari hal tersebut yang membuat seluruh pihak yang berkepentingan harus melakukan upaya penyelidikan dan evaluasi yang menyeluruh terhadap pertandingan ini.

Padahal jelas penggunaan gas Air mata tersebut dilarang oleh FIFA. FIFA dalam Stadium Safety and Security Regulation Pasal 19 menegaskan penggunaan gas air mata dan senjata api dilarang untuk mengamankan massa dalam stadion.

Kami menilai bahwa tindakan aparat dalam kejadian tersebut bertentangan dengan beberapa peraturan sebagai berikut :
1. Perkapolri No.16 Tahun 2006 Tentang Pedoman pengendalian massa
2. Perkapolri No.01 Tahun 2009 Tentang Penggunaan Kekuatan dalam Tindakan Kepolisian
3. Perkapolri No.08 Tahun 2009 Tentang Implementasi Prinsip dan Standar Hak Asasi Manusia Dalam Penyelenggaraan Tugas Kepolisian Negara RI
4. Perkapolri No.08 Tahun 2010 Tentang Tata Cara Lintas Ganti dan Cara Bertindak Dalam Penanggulangan Huru-hara
5. Perkapolri No.02 Tahun 2019 Tentang Pengendalian Huru-hara

Berdasarkan itulah, kami menilai penanganan aparat dalam mengendalikan masa berpotensi terhadap dugaan Pelanggaran HAM dengan meninggalnya lebih dari 150 tewas dan ratusan luka-luka.

Maka dari itu kami menyatakan sikap:

1. Mengecam Tindak represif aparat terhadap penanganan suporter dengan tidak mengindahkan berbagai peraturan, terkhusus Implementasi Prinsip HAM POLRI.

2. Mendesak Negara untuk segera melakukan penyelidikan terhadap tragedi ini yang mengakibatkan Jatuhnya 153 Korban jiwa dan korban luka dengan membentuk tim penyelidik independen.

3. Mendesak Kompolnas dan Komnas HAM untuk memeriksa dugaan Pelanggaran HAM, dugaan pelanggaran profesionalisme dan kinerja anggota kepolisian yang bertugas.

4. . Mendesak Propam POLRI dan POM TNI untuk segera memeriksa dugaan pelanggaran profesionalisme dan kinerja anggota TNI-POLRI yang bertugas pada saat peristiwa tersebut;

5. Mendesak KAPOLRI untuk melakukan Evaluasi secara Tegas atas Tragedi yang terjadi yang memakan Korban Jiwa baik dari masa suporter maupun kepolisian;

6. Mendesak Negara cq. Pemerintah Pusat dan Daerah terkait untuk bertanggung jawab terhadap jatuhnya korban jiwa dan luka-luka dalam tragedi Kanjuruhan, Malang. (matt)
